StopScam Terms of Use

  1. About StopScam
    StopScam is a mobile application and related services (collectively, the "Services" or the "Application") provided by StopScam LLC ("Company," "we," "us," or "our"). The Services are designed to analyze user-submitted materials (e.g., letters, messages, screenshots, images, text documents) to identify potential fraud and reduce financial or personal harm. We utilize artificial intelligence (AI) technologies, including Optical Character Recognition (OCR) and third-party APIs (such as the OpenAI ChatGPT API), to provide enhanced analysis and recommendations.     1.1. Freemium Model
    This Application is offered by the Service Provider as a Freemium service. Certain features are available free of charge, while premium features may require payment or a subscription. By using the free tier or upgrading to a premium plan, you agree to any relevant terms or conditions that may apply.

    1.2. Third-Party Services
    The Application may rely on or integrate with various third-party services (e.g., Google Play Services, Google Analytics for Firebase, Firebase Crashlytics, Apphud, App Store services) for analytics, crash reporting, and other functionalities. Please review each service’s respective terms and policies, as we are not responsible for their content or practices.

  1. User Eligibility
    2.1. Age Requirement
    You must be at least 18 years old to use the Services. By using our Services, you represent that you are 18 or older.

    2.2. Account Registration
    To access certain features, you may need to register an account. You agree to provide accurate, current, and complete information and to update it as necessary.

    2.3. Authority
    If you use the Services on behalf of another individual or entity, you represent that you have the authority to bind that party to these Terms.

    2.4. Children (COPPA)

    • Our Services are intended for users 18 years or older.

    • We do not knowingly collect personal information from individuals under 18. By using the Services, you represent that you meet the age requirement.

  1. License and Permitted Use
    3.1. License Grant
    StopScam LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for your personal, non-commercial purposes, subject to these Terms.

    3.2. Permitted Use
    You may:

    • Upload images, screenshots, texts, and documents for fraud detection and analysis.

    • Obtain fraud risk assessments and recommendations.

    • View your history of previous analyses.

    • Receive personalized advice and guidance to protect your interests.

    3.3. Prohibitions on Copying and Modification
    Unauthorized copying or modification of the Application or any part of it is strictly prohibited. Any attempts to extract the source code, translate the Application into other languages, or create derivative versions are likewise prohibited.

  1. Prohibited Uses
    You agree not to:

  • Use the Services for unlawful, harmful, or offensive activities.

  • Infringe, misappropriate, or violate third-party rights (including intellectual property rights).

  • Modify, adapt, decompile, reverse-engineer, or otherwise tamper with the Services or their components.

  • Distribute, sell, or license any part of the Services without our prior written consent.

  • Upload or transmit content that is illegal, harmful, offensive, or violates applicable laws or regulations.

  • Circumvent or disable security features of the Services.

  • Use automated means (e.g., scraping) to extract data or develop competing products or services.

  • Misrepresent AI-generated outputs as human-generated if they are not.

  • Interfere with or disrupt the Services, servers, or networks connected to the Services.

  • Use the Services in violation of OpenAI’s Usage Policies or any other integrated third-party service terms.

  1. Intellectual Property Rights
    5.1. Ownership
    All rights, title, and interest in and to the Services, including intellectual property rights, belong to StopScam LLC and its licensors. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

    5.2. Trademarks
    You may not use any trademarks, logos, or service marks displayed in the Services without our prior written permission.

    5.3. Feedback
    Any feedback, suggestions, or comments you provide are entirely voluntary and may be used by us without obligation or compensation.

  1. Third-Party Services
    6.1. OpenAI API
    We use the OpenAI ChatGPT API. By using the Services, you agree to comply with OpenAI’s Terms of Use and Privacy Policy.

    6.2. Other Third-Party Providers
    The Services may integrate with other third-party services (e.g., Google Play Services, Google Analytics for Firebase, Firebase Crashlytics, Apphud, App Store services), each with its own terms and privacy policies. We are not responsible for their content, availability, or practices.

    6.3. Data Transmission
    Your information may be transferred to and processed by third parties (including OpenAI) in accordance with their respective privacy policies.

  1. Subscriptions and Payments
    7.1. Free Analysis and Paywalls

    • You receive one (1) free analysis with a result. After that, a paywall appears: “Sign up for a 3-day trial, then $2.99/month or $19.99/year.”

    • If you decline, a discount paywall appears with a first-month price of $1.99 or a first-year price of $14.99 (limited-time offer, discount valid for 24 hours only).

  1. Data Processing and Retention
    We process certain categories of data to improve detection accuracy and ensure security. For instance:

  • Uploaded content (screenshots, texts, images): Stored up to 30 days to allow review and model improvement.

  • Extracted anonymized text: Stored up to 1 year to improve AI models.

  • Metadata (phone numbers, URLs): Retained up to 30 days, flagged data up to 5 years for enhanced threat detection.

  • Device data (OS, installation ID): Stored up to 36 months for compatibility and user-experience improvements.

  1. How StopScam Works
    StopScam uses AI and OCR to analyze uploaded content and provide a fraud risk assessment and recommendations to help you mitigate potential scams.

    9.1. Scam Risk Assessment Categories
    Below is the meaning of each risk assessment range that StopScam may display in its reports:

    1. Likely Not Scam (1–15%)

      • Characteristic: Extremely low probability of fraud.

      • Comment: Although a small risk always exists, the document does not exhibit typical scam signs.

    2. Potentially Safe (16–40%)

      • Characteristic: Document does not appear fraudulent, but some elements need verification.

      • Comment: A few questionable points exist—remain vigilant, double-check links or senders.

    3. High Scam Risk (41–70%)

      • Characteristic: A significant likelihood of fraud.

      • Comment: Urgent requests, ambiguous links, official name errors, etc. Treat with caution, verify authenticity.

    4. Potential Scam (71–99%)

      • Characteristic: High confidence it’s fraudulent.

      • Comment: Most classic scam signs (fake links, money requests, major errors). Immediately cease interaction, report to authorities.

  • Comprehensive Threat Analysis: Identify scams in texts, emails, social media posts, web links, and physical letters.

  • Privacy-Focused: Data handling aligned with global privacy standards (including GDPR and CCPA).

  • Continuous Improvement: Ongoing AI model training for enhanced accuracy.

  1. User Commitments
    By using StopScam, you agree to:

  • Provide accurate, lawful, and relevant content.

  • Refrain from uploading illegal, harmful, or inappropriate material.

  • Use the Services ethically and not for malicious purposes or unfair competition.

  • Comply with all applicable laws, regulations, and standards.

  1. AI Accuracy and Limitations

  • No Guarantee of Accuracy: AI results are probabilistic and not guaranteed correct.

  • User Responsibility: Independently verify results before making financial or legal decisions.

  • No Liability for Outcomes: StopScam LLC is not liable for actions taken based on analysis results.

  • No Professional Advice: The Services do not provide legal or financial advice.

  • Disclaimer on Accuracy: Outputs may be incomplete or incorrect and do not represent the views of StopScam LLC.

  1. Data Privacy and Security

  • Data Protection Compliance: We comply with applicable laws (GDPR, CCPA where relevant).

  • User Rights: You may have rights to access, correct, or delete your personal data.

  • Encryption and Security Measures: We use secure transmission and safeguards against unauthorized access.

  • Cookies: We use cookies and similar technologies to enhance user experience.

  • Third-Party Providers: Data may be processed by third parties (including OpenAI) under their privacy policies.

  1. Disclaimer of Warranties

  • As-Is Basis: The Services are provided “as is” and “as available.”

  • No Guarantee of Service Quality: We do not warrant uninterrupted, error-free, secure, or virus-free Services.

  • User Assumption of Risk: You use the Services at your own risk.

  1. Limitation of Liability

  • No Indirect Damages: To the fullest extent permitted by law, neither StopScam LLC nor its affiliates or licensors are liable for indirect, incidental, or consequential damages.

  • Liability Cap: Our total liability will not exceed the amount you paid over the past 12 months.

  • No Responsibility for Use: We assume no responsibility for how you use the Services.

  • Jurisdictional Variations: These limitations apply to the extent allowed by law.

  1. Indemnification
    If you are a business or organization, to the extent permitted by law, you agree to indemnify and hold harmless StopScam LLC, its affiliates, licensors, and service providers from any claims or damages arising from your breach of these Terms or misuse of the Services.

  1. Dispute Resolution and Arbitration

  • Mandatory Arbitration: Disputes shall be resolved by final and binding arbitration administered by the AAA.

  • Class Action Waiver: You agree to resolve disputes individually and waive class actions.

  • Governing Law for Arbitration: The Federal Arbitration Act governs this section.

  1. Termination of Services

  • By Company: We may suspend or terminate your account for violations of these Terms.

  • By User: You may cease using the Services at any time by deleting the Application.

  • Effect of Termination: Rights and licenses immediately end upon termination.

  1. Changes to Services and Terms

  • Service Changes: We may modify, suspend, or discontinue the Services at any time.

  • Amendment of Terms: Material changes will be notified at least 30 days in advance.

  • Continued Use: Continuing to use after changes indicates acceptance.

  1. Force Majeure
    We are not liable for delays/failures due to circumstances beyond our reasonable control (natural disasters, government actions, internet outages).

  1. Governing Law and Venue

  • Governing Law: The laws of the State of Delaware, USA, govern these Terms.

  • Venue: Legal actions must be brought in New Castle County, Delaware.

  1. Severability
    If any provision is invalid or unenforceable, the remaining provisions remain in force.

  1. Assignment

  • By You: You may not assign rights or obligations without our consent.

  • By Us: We may assign our rights/obligations in a merger, acquisition, or asset sale.

  1. Entire Agreement
    These Terms, along with our Privacy Policy, constitute the entire agreement between you and StopScam LLC.

  1. No Third-Party Rights
    No provision creates rights for third parties, except as specified in indemnification or liability sections.

  1. Electronic Communications
    By using the Services, you consent to receive communications from us electronically (email, in-app notifications).

    If these Terms are translated, the English version prevails in case of inconsistencies.

    You agree to comply with all applicable laws, including export/trade laws, when using the Services.

  1. Device Responsibility, Internet, and Data Charges

  • Device Security: Keep your device secure; we are not responsible if jailbreaking or rooting impacts functionality.

  • Active Internet: Some features need internet; we’re not liable if the Application doesn’t function fully without a connection.

  • Data Usage: You are responsible for any carrier data charges.

  • Device Battery: You must ensure your device is charged.

  1. No Guarantee of Updates

  • Updates: We may update the Application but have no obligation to do so.

  • Discontinuation: We may discontinue the Application without prior notice.

  1. Trade Controls and Sanctions
    You represent you are not located in a sanctioned country or on a prohibited list. You agree not to export the Services in violation of relevant controls or sanctions.

  1. Waiver
    Our failure to enforce any provision is not a waiver of that right or provision.

  1. Copyright Complaints
    If your copyright is infringed, contact support@stopscam.ai with:

  • A signature of the authorized representative.

  • Description of the copyrighted work and alleged infringement.

  • Your contact details.

  • Statement of good-faith belief.

  • Statement under penalty of perjury of your authority and accuracy.

    Any feedback you provide is voluntary; we may use it without obligation or compensation.

StopScam LLC assumes no responsibility or liability for any third-party websites or services—access them at your own risk.

  1. Displayed Savings Estimate
    When a document is flagged as scam or high risk, the Application may display an estimated amount of money saved. This figure is for informational purposes only and based on general data about potential losses. StopScam LLC does not guarantee that you would have actually lost this amount, and we disclaim liability for any reliance on the estimate.
